These Terms of Service govern your access to and use of the BØRNLY website, available at babybornly.com, and your purchase of products from BØRNLY.

Throughout these Terms, the terms “BØRNLY”, “we”, “us” and “our” refer to:

By visiting our website, placing an order or otherwise using our services, you agree to these Terms of Service.

Nothing in these Terms limits any mandatory consumer rights that apply to you under the laws of your country.

1. About our website

BØRNLY operates an online store offering breastfeeding and motherhood-related products, accessories and related items.

We may update, improve, remove or change parts of the website and our product range from time to time.

Access to the website is provided on a temporary basis. We may suspend parts of the website when reasonably necessary for maintenance, security, technical improvements or other operational reasons.

2. Eligibility

You must be at least 18 years old, or have permission from a parent or legal guardian, to place an order through our website.

By placing an order, you confirm that:

  • the information you provide is complete and accurate;

  • you are authorised to use the selected payment method;

  • you are legally capable of entering into a purchase agreement.

We may refuse or cancel an order when we reasonably believe that it involves fraud, unauthorised payment, misuse of the website or a violation of these Terms.

3. Product information

We make reasonable efforts to ensure that product descriptions, photographs, specifications, colours, dimensions, prices and availability are accurate.

The appearance of colours may vary slightly depending on your screen, device settings and lighting conditions. Minor differences that do not affect the normal functionality of the product will not necessarily constitute a defect.

Product images may contain accessories or decorative items that are not included. The product page and order confirmation will specify what is included in your purchase.

We reserve the right to correct obvious errors in product descriptions, prices or other website information.

4. Orders and contract formation

Products displayed on our website constitute an invitation to place an order.

When you place an order, you make an offer to purchase the selected products. After receiving your order, we will send you an electronic order confirmation.

A purchase agreement is formed when we accept your order by sending an order confirmation or shipping confirmation, depending on the wording displayed during checkout.

We may decline or cancel an order before shipment when:

  • the product is unavailable;

  • payment cannot be authorised;

  • the price or product information contains an obvious error;

  • the delivery address is incomplete or outside our available delivery area;

  • we reasonably suspect fraud or unauthorised activity.

When we cancel a paid order, we will refund the amount paid using the original payment method.

5. Prices and payment

Prices are displayed in the currency shown on the website.

Any applicable VAT or sales tax will be included or displayed during checkout as required by applicable law.

Before completing your order, you will be shown the total amount payable, including any applicable shipping costs, taxes or other charges collected by us.

Available payment methods are displayed during checkout. Payment must be completed before an order is processed unless we expressly offer another payment arrangement.

You are responsible for providing accurate billing and payment information.

We do not store complete payment-card details. Payments may be processed by independent payment-service providers subject to their own terms and privacy policies.

6. Discount codes and promotions

Discount codes and promotional offers:

  • are valid only during the stated promotional period;

  • cannot be exchanged for cash;

  • cannot be applied after an order has been completed;

  • may be limited to one code per order;

  • may exclude certain products or delivery costs;

  • may not be combined unless expressly stated otherwise.

We may cancel or refuse a promotion when it is used fraudulently, unlawfully or contrary to its stated conditions.

Mandatory consumer rights are not affected by promotional conditions.

7. Shipping and delivery

BØRNLY offers worldwide delivery to the destinations available during checkout.

Estimated delivery times are estimates rather than guaranteed delivery dates unless we expressly agree to a specific date.

Delivery may be affected by:

  • customs processing;

  • carrier delays;

  • public holidays;

  • severe weather;

  • incorrect address information;

  • circumstances outside our reasonable control.

We will provide tracking information when tracked delivery is available.

You are responsible for entering a complete and accurate delivery address. Contact us immediately at info@babybornly.com when you notice an error.

We cannot guarantee that an address can be changed once an order has entered processing or has been shipped.

8. Customs duties and import taxes

International orders may be subject to customs duties, import taxes, handling charges or other local fees.

Unless checkout expressly states that duties and taxes are included, these charges may be collected separately by local authorities or the delivery carrier.

The customer is responsible for applicable import charges that are not collected by BØRNLY during checkout.

Customs processing may delay delivery. BØRNLY does not control decisions or processing times of customs authorities.

9. Risk and ownership

Responsibility for the products passes to you when the order is delivered to you or to a person designated by you to receive it.

Ownership passes to you after we have received full payment for the order and the order has been delivered.

Please contact us promptly when tracking shows that an order was delivered but you have not received it.

We will try to process your request, but we cannot guarantee cancellation once an order has entered processing or has been shipped.

When an order has already been shipped, you may request a return after receiving it in accordance with our Return & Refund Policy.

11. Returns and refunds

BØRNLY offers a voluntary 60-day return period, calculated from the day you receive your order.

Return requests must be submitted by email to:

Products returned under our voluntary 60-day policy must comply with the conditions stated in our Return & Refund Policy.

The voluntary 60-day return policy is additional to, and does not replace or reduce, any mandatory right of withdrawal, guarantee or other consumer right that applies under applicable law.

Do not send products back before receiving return instructions and the correct return address from us.

Our separate Return & Refund Policy forms part of these Terms of Service.

12. Hygiene-sensitive products

Certain products and components may be delivered with a hygiene or tamper-evident seal because they are intended to come into contact with the body, breast milk or other bodily fluids.

Where legally permitted, products may not qualify for a change-of-mind return after the relevant hygiene seal has been opened, removed or broken.

This may apply to sealed milk-contact components such as:

  • breast shields and flanges;

  • flange inserts;

  • milk-collection components;

  • valves and membranes;

  • diaphragms and seals;

  • other sealed hygiene-sensitive accessories.

This restriction does not remove your rights when a product is damaged, defective, incorrectly supplied or does not conform to the purchase agreement.

13. Damaged, defective or incorrect products

Please inspect your order as soon as reasonably possible after delivery.

When a product arrives damaged, defective, incomplete or incorrect, email us at info@babybornly.com and include:

  • your name and order number;

  • a description of the issue;

  • clear photographs or video;

  • photographs of the packaging and shipping label, where relevant.

Depending on the circumstances and your applicable rights, an appropriate solution may include:

  • providing a missing component;

  • repairing the product;

  • replacing the product;

  • reducing the price;

  • issuing a full or partial refund.

Our commercial or voluntary guarantees do not replace the legal guarantee and conformity rights available to consumers.

14. Lifetime Motor & Electronics Warranty

In addition to any statutory consumer rights that apply to your purchase, eligible BØRNLY wearable breast pumps are covered by our Lifetime Motor & Electronics Warranty.

This commercial warranty applies to the original purchaser and covers manufacturing defects in the pump motor and core internal electronic components during the period described in our separate Lifetime Warranty Policy.

The commercial warranty does not cover normal wear and tear, cosmetic damage, accidental damage, misuse, unauthorised modifications or repairs, damage caused by failure to follow the supplied instructions, or replaceable and hygiene-sensitive components that naturally wear through normal use, including silicone flanges, flange inserts, valves, membranes, diaphragms and seals.

Natural reduction in rechargeable-battery capacity resulting from normal use and ageing is not considered a manufacturing defect under the Lifetime Motor & Electronics Warranty. This does not affect any statutory rights that may apply if a battery or other component is defective or does not conform to the purchase agreement.

To request warranty service, contact info@babybornly.com and provide your order number, a description of the issue and reasonable supporting information such as photographs or video where relevant. We may request reasonable troubleshooting steps before confirming a warranty solution.

Where a valid claim is accepted under the Lifetime Motor & Electronics Warranty, BØRNLY will, at no charge to the customer, repair the covered defect or replace the affected pump or covered component with the same model or a functionally equivalent replacement where the original model is no longer available.

The Lifetime Motor & Electronics Warranty is an additional commercial warranty. It does not replace, restrict or reduce any statutory guarantee, conformity, repair, replacement, price-reduction or refund rights available under applicable consumer law.

The separate Lifetime Warranty Policy forms part of these Terms of Service and contains the complete scope, eligibility requirements, exclusions and claim procedure.

15. Safe product use

You must read and follow all instructions, warnings, hygiene guidance, cleaning instructions and maintenance requirements supplied with the product.

Only use the product:

  • for its intended purpose;

  • with compatible BØRNLY components or approved accessories;

  • in accordance with the user manual;

  • within the operating and charging conditions stated in the instructions.

Stop using the product when it appears damaged, overheats, leaks, produces an unusual smell, has damaged electrical components or otherwise appears unsafe.

Do not attempt to open, alter or repair electrical components unless the instructions expressly permit this.

Improper use, unauthorised modification or failure to follow the instructions may damage the product and could affect voluntary warranty coverage. Mandatory consumer rights remain unaffected.

16. Medical information

Information on our website, social-media channels, packaging or other materials is provided for general educational and product-information purposes.

It is not a substitute for individual medical advice, diagnosis or treatment from a qualified healthcare professional.

Breastfeeding experiences and medical circumstances differ between individuals. Contact a qualified healthcare professional when you have concerns about breastfeeding, milk production, pain, bleeding, infection, medication or the health of you or your baby.

In an urgent or emergency situation, contact the appropriate local emergency or medical service.

17. Accounts

When account registration is available, you are responsible for:

  • keeping your login details confidential;

  • maintaining accurate account information;

  • activity performed through your account;

  • notifying us of suspected unauthorised access.

We may suspend an account when reasonably necessary to protect the customer, BØRNLY or other users from fraud, security threats or misuse.

18. Customer reviews and other content

When you submit a review, photograph, video, testimonial or other content to us, you confirm that:

  • the content reflects your genuine experience;

  • you have the right to submit it;

  • it does not infringe another person’s rights;

  • it is not unlawful, misleading, threatening or offensive;

  • it does not contain malicious software or unauthorised advertising.

You retain ownership of your content.

You grant BØRNLY a non-exclusive, worldwide, royalty-free licence to store, reproduce, publish and display the submitted content for operating and promoting our business, unless a different arrangement has been agreed.

We may remove content that violates these Terms or applicable law. We will not knowingly present paid or incentivised reviews as independent reviews.

19. Intellectual property

The website and its contents, including the BØRNLY name, logos, product designs, photographs, videos, text, graphics, packaging, layout and software, are owned by or licensed to BØRNLY and are protected by applicable intellectual-property laws.

You may use the website only for personal, non-commercial shopping purposes.

Without our prior written permission, you may not:

  • copy or reproduce website content for commercial purposes;

  • use BØRNLY branding in a way that suggests authorisation or affiliation;

  • resell, scrape or systematically collect website content;

  • reverse engineer or interfere with website functionality;

  • use product images or text to sell counterfeit or unauthorised products.

20. Prohibited conduct

You may not use the website:

  • for unlawful, fraudulent or deceptive purposes;

  • to place orders using stolen or unauthorised payment information;

  • to introduce malware, viruses or harmful code;

  • to interfere with the security or operation of the website;

  • to collect personal information about others without permission;

  • to impersonate another person or business;

  • to violate intellectual-property or privacy rights;

  • to make fraudulent refund, chargeback or delivery claims.

We may restrict access, cancel orders or report activity to relevant service providers or authorities when reasonably necessary and legally permitted.

These services are operated independently and may have their own terms and privacy policies.

BØRNLY is not responsible for the independent content, security, availability or conduct of third-party websites, except where responsibility cannot legally be excluded.

22. Website availability and security

We take reasonable measures to maintain the security and availability of our website.

However, we cannot guarantee that the website will always be uninterrupted, error-free or free from every security threat.

You are responsible for using appropriate security measures on your own device and internet connection.

We may temporarily restrict access for maintenance, technical issues, security concerns or circumstances outside our reasonable control.

23. Liability

BØRNLY is responsible for losses that are a foreseeable result of our breach of these Terms or our failure to exercise reasonable care.

To the maximum extent permitted by law, we are not responsible for indirect or unforeseeable losses, or for losses caused by circumstances outside our reasonable control.

When you purchase as a consumer, we do not exclude or limit liability that cannot legally be excluded or limited.

Nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation;

  • deliberate misconduct or gross negligence where applicable;

  • defective products where liability cannot legally be excluded;

  • mandatory consumer guarantees or conformity rights;

  • any other liability that cannot legally be limited.

We are not responsible for damage caused by improper use, unauthorised alteration, failure to follow supplied instructions or use with incompatible components, except where applicable law provides otherwise.

24. Force majeure

We are not responsible for delays or failure to perform caused by events outside our reasonable control, including natural disasters, war, civil unrest, government restrictions, epidemics, cyberattacks, transport disruptions, carrier interruptions, customs delays, labour disputes or utility failures.

We will take reasonable steps to reduce the effect of the event and resume performance when reasonably possible.

Your mandatory rights regarding delayed or failed delivery remain unaffected.

25. Privacy and personal data

Our processing of personal data is described in our separate Privacy Policy.

By using the website, you acknowledge that your personal data may be processed as necessary to:

  • process and deliver orders;

  • provide customer support;

  • prevent fraud;

  • meet legal and tax obligations;

The remaining provisions will continue to apply.

These Terms and purchase agreements with BØRNLY are governed by the laws of the Netherlands.

When you are a consumer living in another country, this choice of law does not remove any mandatory consumer protection provided by the laws of your country of residence.

We encourage you to contact us first so we can try to resolve your complaint directly.

Disputes may be submitted to the courts that have jurisdiction under applicable consumer and procedural law.
